A Wollongong judge yesterday foreshadowed a hefty jail sentence for a man he described as a despicable character for subjecting a bus driver to a sickening assault at the wheel.Ian Chalmers, bloodied and dazed, battled for nearly a kilometre to maintain control of his bus as he was repeatedly kicked in the back of the head by the disgruntled passenger.After viewing CCTV footage of the attack, Judge Paul Conlon said James Joseph Elphick's assault on Ian Chalmers was one of the worst he had seen.WARNING: This footage of the attack is extremely violent and is suitable for mature audiences only.He said the 20-year-old deserved more than the maximum sentence available to impose, so he adjourned sentencing for a week to review the matter."(The video) shows Elphick repeatedly delivering full-blooded kicks to the back of the driver's head while he is trying to control the bus," Judge Conlon said.Elphick, of Berkeley, pleaded guilty to assault occasioning actual bodily harm and affray.The offences were committed about 11pm on February 11 this year - the night of the Anthony Mundine-Shannan Taylor boxing match, less than two months after Elphick was released from jail for unrelated matters.The court heard he was the last person on Mr Chalmers' Wollongong-Warilla bus and became aggressive when the driver refused to drop him home after he fell asleep and missed his stop.When Elphick began kicking the driver to the back of the head, Mr Chalmers accelerated the bus to throw him off balance."The accused has fallen backwards and immediately stood up and taken hold of the roof bars to steady himself," the police facts said."He then swung from the bars and kicked Mr Chalmers to the back of the head, neck and back."Mr Chalmers nearly lost consciousness from what he described as "endless blows".The kicks were so forceful they forced Mr Chalmers to veer several times onto the wrong side of the road.Mr Chalmers tried to stop the attack by throwing a money tin in defence, which he said only made Elphick kick harder.By this stage, Mr Chalmers was dazed and bleeding heavily.He mounted the bus onto a kerb on the north-west corner of Shellharbour and Wattle roads at Shellharbour, outside the 7-Eleven petrol station.One of three motorists travelling behind the bus pulled in, boarded the bus and threw Elphick off.Police were called and Elphick was arrested and charged.Elphick, from the witness box yesterday, said he had little memory of the attack due to the fact he had been drinking after attending the boxing match in Wollongong. He admitted he had a drinking problem and needed to attend Alcoholics Anonymous.Elphick said he was "shocked and surprised" when shown the video.Judge Conlon adjourned sentencing for a week.He said yesterday he was concerned that "procedural circumstances" relating to the charges before him restricted his sentencing and prevented him from delivering an appropriate sentence for the crime.
