Jeffrey Silk forfeited his right to a licence the night he drove at breakneck speed down Mt Ousley Rd with his children in the car, Wollongong Local Court heard yesterday.
Silk, a single father from Gwynneville, was in court to appeal the RTA's decision to cancel his licence for six months for driving more than 45km/h over the limit.
Police clocked his Toyota Camry travelling at 158km/h, reducing to 153km/h over a four-second time-frame shortly after 9pm on May 19.
"I was going down the hill and needed to give it a bit so it could get up the other side," he told the police officer on the night of the offence.
"That's no excuse, especially on that dangerous road," magistrate Michael Stoddart said yesterday.
Silk gave evidence he was paying off the $1744 fine, but needed his licence to take his children, aged 8 and 11, to and from school.
He said he also did volunteer work and needed a car to look for work.
"You say you have a need for a licence because you are a sole parent," Mr Stoddart said.
"Then you put them in the car with you and drive at this ridiculous speed.
"Aren't you ashamed of yourself?"
"I'd rather have them with me than sitting at home alone," Silk replied.
Mr Stoddart said the court also had to take into account a number of other speeding matters on Silk's record.
"You have put your family and other road users at risk and have, therefore, forfeited your right to a driver's licence," Mr Stoddart said.
He dismissed the appeal and allowed the six-month cancellation to stand.
