Man jailed for horrific attack on bus driver

05 Aug, 2009 04:51 PM
A Berkeley man has been jailed for a maximum of two years for the sickening attack on a defenceless Illawarra bus driver earlier this year.

Judge Paul Conlon imposed the maximum sentence available to him on James Joseph Elphick in Wollongong District Court today following the frenzied assault on February 11.

Bus driver Ian Chalmers, bloodied and dazed, battled for nearly a kilometre to maintain control of his bus as he was repeatedly kicked in the back of the head by Elphick.

WARNING: This video is extremely violent and is suitable for mature audiences only

The offences were committed about 11pm on February 11 this year - the night of the Anthony Mundine-Shannan Taylor boxing match, and less than two months after Elphick was released from jail for unrelated matters.

Elphick was the last person on Mr Chalmers' Wollongong-Warilla bus and became aggressive when the driver refused to drop him home after he fell asleep and missed his stop.

When Elphick began kicking the driver to the back of the head, Mr Chalmers accelerated the bus to throw him off balance.

Mr Chalmers nearly lost consciousness from what he described as "endless blows".

The kicks were so forceful they forced Mr Chalmers to veer several times onto the wrong side of the road.

Elphick had pleaded guilty to assault occasioning actual bodily harm and affray, and today Judge Conlon imposed a maximum two-year jail sentence, with a non-parole period of 18 months.

He said Elphick deserved a harsher sentence, however he was restricted in sentencing due to an oversight in charging procedures.

Perhaps the Magistrates in Wollongong could teach their colleagues in Canberra a thing or two. If this had happened in the ACT he would have got a rap on the knuckles, told to go home and be a goo little boy in the future. In fact, the judicial system in Canberra is such a joke you can literally get away with murder and people have.

Why only two years?

Not long enough in jail for such a violent crime. The driver and his family will suffer for far longer than 18 months. The attack was cruel and violent.

The more I hear about Judge Conlon's sentences, the more I like him. Very glad Wollongong has him.

I hope the scurvy little cretin enjoys the same treatment 'inside'. You really are an ass, and an out of control LOSER!

what a weak dog, the bus drivers got his hands full and this coward kicks him and when the driver lunges at him he backs off into the aisle, what about when the other guy helps, he runs away, so so weak

after watching these horrific photos, i think these are the people with whome socity need to meet with iron handed. i would appriciate the judge if he awarded him double of what he got plus rigorous punishment. any way my condolance with brave drive.
