Quattro to rise from ashes?

Disgraced developer Frank Vellar's Quattro proposal could still become a reality, according to Wollongong's administrators who said the proposal could be amended and resubmitted.

Administrators last night rejected the Quattro application which sparked one of the biggest corruption scandals in local government history.

But the proposal may still rise from the ashes if an amended development application is put in which conforms with guidelines.

Administrator Gabrielle Kibble last night said "it would be open" for Mr Vellar to resubmit the proposal on the prominent Keira St site.

"It is always open to any applicant to lodge an application," she said.

The Independent Commission Against Corruption found planner Beth Morgan engineered Quattro's approval in 2005 on behalf of her lover and developer, Mr Vellar.

Last night's rejection of the Quattro proposal followed a Land and Environment Court case where the council successfully argued that Quattro's approval should be voided because it was "tainted by corruption".

The rejection represented the final nail in the coffin for Mr Vellar's original Quattro proposal which exceeded almost every planning guideline in place.

But it is yet to be seen whether he submits an amended version.

Wollongong's administrators also said they are prepared to defend their rejection in the Land and Environment Court, however "(Mr Vellar) will have the right to appeal".

What are people saying here? I live close to this Quattro site.

I and other who live near were really looking forward to having an Italian forum style development on it.

The site should not sit unloved with deteriorating buildings on it. It is the main road into Wollongong after all.

I personally don't care if it is Vellar or someone else who builds it, but I love the concept for that site.

Just reduce the height to fit current zoning standards. That's all.

The Admninistrators are correct. Anyone can relodge or resubmit a Development Application over land they have use rights over. If Vellar owns this site, he like any owner has the right to lodge a DA. Obviously it should be a DA that complied with the Wollongong Local Environment Plan rules, but he still has the right to do this. I would like to see this site developed with funky coffee shops, apartments and I thought the earlier DA has a great indoor acquatic exercise centre in it as well.

Let's not forget what went on here. Resubmitting is not a reward, and a pat on the back to get it right this time.

Alan Bond, what about the most fundamental Rule of Law - innocent till proven guilty?

At this point, Vellar has not been convicted of anything. So barring him from resubmitting a DA is a gross breach of our most treasured legal principle.

Second, Mr Bond appears to believe that someone, if they happen to be convicted or not, should lose their civil rights such their right to deal with their property under NSW laws.

Australia does not punish convicted or accused criminals in this way Mr Bond.

I thank God every day that we live in a society where the rule of law prevails.
