Brett Stewart paralytic, girl's father tells court

22 Mar, 2010 03:31 PM
The Manly fullback Brett Stewart was so drunk he was almost ''paralytic'' after he allegedly sexually assaulted a 17-year-old girl, a court has heard.

Stewart, 24, will defend the allegations at a trial after the Deputy Chief Magistrate, Paul Cloran, ruled there was enough evidence for a properly instructed jury to convict him of an indictable offence.

Stewart arrived at court supported by his family and girlfriend, Jaime Baker, and was on crutches after injuring his knee in the first round NRL match against the Wests Tigers.

The girl's father, who cannot be named for legal reasons, yesterday told the Downing Centre Local Court that when he confronted Stewart shortly after the alleged attack he was ''all over the place'' and speaking nonsense.

''On a scale of one to 10, one being cold sober and 10 being paralytic, how would you describe him to be?'' asked Stewart's barrister, Clive Steirn, SC.

''He was an eight,'' the father replied. The man had told police he noticed Stewart's trousers were open and ''his old guy'' was visible during the confrontation.

He told the court that when Ms Baker had come out of the couple's townhouse she had pointed to his trousers and said, ''Not again.''

The father denied that evidence was ''a pack of lies''. He agreed that Stewart's behaviour had been ''volatile'' and that he had watched the star footballer ''like a hawk'' after having to fend him off with his elbow.

Stewart has pleaded not guilty to two charges that he sexually and indecently assaulted the girl outside the block where he lived on March 6 last year.

Earlier that evening he had attended the Manly club's season launch at the Manly Wharf Hotel before being kicked out of the Steyne Hotel.

The matter was adjourned until April 9.
