TWU South Coast and Southern sub-branch secretary Nick McIntosh said the union raised concerns the company wasn’t paying the superannuation of at least one worker in December, but had been assured payment had been made.
At the time, the company told the TWU it could take three to six months for the money to appear.
Mr McIntosh said it was concerning the superannuation was yet to appear.
‘‘We will be conducting an immediate audit of Kosseris Bulkhaul to get to the bottom of this issue,’’ Mr McIntosh said.
Former employee Matthew Clinch said he was fed up with waiting for the company to pay.
He estimated he was owed about $4000 in unpaid super.
Mr McIntosh said the TWU would consider legal action.
‘‘If required, we will take legal action to ensure that workers like Matthew receive the super and other entitlements they have worked hard for,’’ he said.
The company employs 12 workers.
Company manager Anthony Kosseris said payment had been lodged and was currently in the possession of the Australian Taxation Office.
‘‘We’ve made the payments for super to the tax office,’’ he said.
‘‘It takes the tax office several months to disperse it to the members. I do know some of the drivers have received their super because they’ve asked which period it relates to because it’s gone into their funds.’’
An ATO spokesperson said: ‘‘Due to confidentiality provisions in the Tax Administration Act the ATO cannot comment on any individual’s or entity’s tax affairs.’’
