Sergeant Jason Harrison said a 32-year-old Horsley man had downed numerous alcoholic drinks at his work Christmas Party on Wednesday night, before leaving in search of some food.
"At 2.10am [Thursday] he entered a service station in Dapto where he went to the back of the store and started eating a pie," Sgt Harrison said.
"The attendant told him he had to pay for it and the accused started arguing with him."
The service station attendant locked the front door and the man allegedly hit the attendant.
"This has resulted in a fight, with the Horsley man coming off second best ," Sgt Harrison said.
The attendant unlocked the doors and the man left.
Police were called and a man was arrested on Cleveland Street a short time later.
Police will obtain a statement from the alleged victim and review CCTV footage.
"[This alleged incident is] a sobering reminder that work Christmas party night should not end with an assault investigation being undertaken by police," Sgt Harrison said.
