Robert Nikolovski is accused of coward-punching Troy Fornaciari outside a Wollongong nightclub on September 13 last year in retaliation for Fornaciari allegedly hitting one of his friends in the face earlier that evening.
In court on Wednesday, Nikolovski's lawyers opted to have the affray allegation heard by a 12-member jury, instead of by a magistrate in a local court hearing. Nikolovski will be formally arraigned in the District Court at Campbelltown next month, when a trial date is likely to be set.
He is yet to be committed for trial on the accessory before the fact to a murder charge, relating to the Janceski shooting.
