Daniel Cassoli was with a female friend at a concrete stairwell outside Corrimal Park Mall, just before 9pm on December 5, when events took a more amorous turn.

The woman began to perform oral sex on Cassoli, who was sitting back on one of the steps.

The police were contacted and responded a short time later, parking in an adjacent car park near the pair "who, at this time, had still not noticed the police presence", facts tendered to court noted.

The pair were apparently "stunned" when the officers confronted them moments later.

Cassoli, 47, initially denied the act, but later apologised and admitted they had become "carried away".

Police spoke to a number of witnesses, who also mentioned the pair had been "shooting up" prior to the sexual act.

The officers found a Commonwealth Bank Mastercard with another man's name in Cassoli's wallet, which he claimed he had found and planned to hand in to police.

He was later charged with committing an act of indecency and having goods in custody suspected of being stolen.

On Monday Magistrate Michael Stoddart sentenced Cassoli to three months' jail for each offence.
