Maxwell Albert Williams is alleged to have indecently assaulted the girl twice and sexually assaulted her once in his Berkeley home between 2004 and 2006 when she was six to eight years old.
It is alleged he “blew raspberries” on her stomach and crotch while she still had her clothing on on two occasions and took off her shorts and molested her on another occasion.
Police documents tendered to Port Kembla Local Court said the girl’s family developed a friendship with Williams while living in the Berkeley area between mid-2004 and mid-2006, and she and her brother would drop into his place on occasions after visiting the public pool.
The girl told police during one of these visits Williams lifted her up and used his mouth to blow “raspberries” on her stomach, then on her crotch area while she was wearing swimmers and shorts.
It is alleged the sexual assault happened on the same day while Williams was playing hide and seek with the siblings.
The girl claims Williams took her to a small bedroom underneath the stairs, motioned for her to keep quiet then sexually assaulted her.
“The victim indicated the accused let her go and stopped what he was doing upon her brother calling out to her,” the police documents said.
The children left the house shortly afterwards.
Williams allegedly assaulted the girl again a few weeks later during another visit to the man’s house.
The girl said she and Williams were in a bedroom on the second floor of the house when Williams again used his mouth to blow raspberries on her stomach and crotch.
“The indecent assault occurred only for a short time, before the girl ran down the stairs and found her brother,” police wrote.
The girl reported the alleged incidences to police in 2008, however the case was suspended in early 2009.
It was reopened in May 2015 and the girl conducted another interview with police.
Williams was arrested outside Port Kembla Local Court on Wednesday and charged with two counts of child indecent assault and one count of sexual intercourse with a person under 10 years.
He faced court on Thursday, where prosecutors urged the court to keep Williams behind bars.
“His record is littered with predatory offences against children...he’s previously served time in prison for child sex offences,” prosecutor Sergeant Davis said.
Magistrate Michael Stoddart refused Wiliams’ application for bail, saying he had not shown strong enough reasons why he shouldn’t stay behind bars.
The case will return to court on December 2.
