A District Court judge has quashed a jail sentence handed to a University of Wollongong student who flogged thousands of dollars worth of stolen clothes and accessories on Ebay, on account of the woman’s significant mental health problems.

Amanda Monks was given an eight month jail sentence in Port Kembla Local Court last month after confessing to stealing $22,000 worth of brand-name goods from Myer and David Jones and selling the items on Ebay during a six-month period last year.
Monks’ scheme was uncovered after a Myer fraud analyst discovered a tank top being advertised on the site was so new to stores only one had been sold – to a person in Victoria.
During a severity appeal in the NSW District Court on Tuesday, defence lawyer Elizabeth Parkes said Monks had significant mental health problems that had contributed to her offending.
Judge Norman Delaney agreed to suspend Monks’ jail sentence but increased the term to two years, with supervision from authorities.
