Craig Martin Robinson pleaded guilty to wielding the tiny gun, given to him by his father as a child, during a confrontation over drugs at a Warrawong apartment block last December.
The gun was so small the victim initially thought it was a toy, but that didn’t stop he and Robinson wrestling for control of it.
The pistol fired during the struggle, putting a bullet in Robinson's upper left leg.
He underwent surgery, however the bullet was not removed because of its proximity to the femoral artery.
NSW District Court judge Norman Delaney ordered Robinson to be assessed for an intensive correction order, which, if successful, would allow him to serve his sentence in the community.
