Cloud 9 opened its doors in Smart Street Mall on November 19 following strong opposition from community members including Mandurah MP David Templeman.

Last Tuesday a police search of the premises led to the seizure of items police say they reasonably suspect of being psychostimulants.

Mandurah officer in charge, Senior Sergeant Glen Willers, said the goods seized had been on public sale, and would be analysed.

Snr-sgt Willers said Cloud 9 staff were “fully cooperative” during the search which, thanks to new legislation that came into effect on November 18, did not require a warrant to conduct.

“The new legislation allows us to search these places without a warrant,” he said.

“Until we find out exactly what the items are through analysis, our inquiries will continue.”

Snr-sgt Willers said his team would continue to investigate the sale of synthetic stimulants and did not rule out further searches of the premises.

Under the new legislation regarding psychoactive substances, the sale, supply, manufacture, advertising and promotion of any psychoactive substance, or any substance purported to have a psychoactive effect, is prohibited.

Police have the power to seize and destroy any substance which has a psychoactive effect with penalties up to $48,000 or four years in jail applying to those selling such drugs.

Daniel Ng, who told Mandurah Mail he was a “representative” for Cloud 9 said he was not aware of the search or subsequent seizure and refused to provide comment on the matter.
