A Dapto man was charged with break and enter and assault offences over an alleged incident on Friday night.
Police state the man and his partner argued on Thursday and, on Friday afternoon, she told him she would not go on a planned holiday and wanted nothing to do with him.
Police allege the man returned to her house in Oak Flats, breaking in and driving away in her car.
He returned a short while later and, according to police, drove the car into the garage. Police claim he pinned the woman to the rear wall with the car – she was later treated for two fractures to her leg.
He then allegedly took the woman inside the house, threw her on the bed, ripped off her underwear and threatened to rape her.
The woman begged to be taken to hospital, to which he agreed. It was while at the hospital that he was arrested by police.
In a police interview, he said the woman was pinned by the car due to his wet thong slipping on the accelerator.
He also denied any threat to rape her, said he put her on the bed because she was hurt and removed her underwear because “it was inappropriate to wear to hospital”.
Police prosecutor Sergeant Ben Hart opposed bail, citing the woman’s “harrowing” tale.
“She was run down by her own car in her own home and then threatened with sexual assault in her own bed,” Sgt Hart said.
His solicitor Mr Ward took issue with the police facts that allege verbal and physical arguments in the days leading up to the incident – arguments which were not reported to police.
He also said his client’s decision to drive the victim to hospital did not fit with the police statement.
Magistrate Susan McGowan said the police facts of the case were “appalling”.
She refused bail, stating there were no bail conditions that could protect the alleged victim.
He was remanded to appear at Wollongong Local Court on March 23.
