Wayne Pullen, 60, from Thirroul, is charged with five counts of ‘peep or pry’ over allegations he spied on swimmers between March 7 and March 14.
His lawyer, Jeff David, told the court on Tuesday he would lodge an application on Pullen’s behalf to have the charges dismissed under mental health legislation.
As part of the application, Pullen must be assessed by a psychologist or psychiatrist and have a report prepared for the court outlining any mental health conditions.
The matter returns to court September 5.
