Rodney John Kip, 49, of Kalandar Street, pleaded guilty to maliciously damaging property, common assault and intimidation in Nowra Local Court on Monday.
Police were called to the Shoalhaven Seafoods takeaway in East Nowra around 5.50pm on August 19 after Kip and co-accused, Joy Warner, 50, also of Kalandar Street, entered the store and started harassing two female staff members.
The court heard they had an ongoing feud with one of the business owners.
Kip and Warner acted in an aggressive manner towards the two women, with Kip asking for the owner of the business and threatening to “come to your f...ing house”.
When told to leave, Kip hit a napkin container on top of the store counter towards the women, while Warner also threw items at the pair.
Kip stayed in the store flailing his arms around before spitting in the deep fryer.
He then told patrons “not to eat their f...ing food I just spat in the fryer” before attempting to do it a second time.
Warner also pushed a napkin container from the counter to the floor which hit the glass front panel, smashing it.
The whole incident was captured on CCTV.
The pair left the business with police arresting them a short time later in a house across the street.
Police said both were moderately to well intoxicated and were well animated while in custody.
Magistrate Gabriel Fleming sentenced Kip to nine months’ jail from September 9, with a non-parole period of three months.
He will be eligible for parole on December 4.
Warner pleading guilty to maliciously damaging property and common assault, with Magistrate Fleming fining her $1600 and placing her on a 12-month good behaviour bond.
