Amy Bozinovski, 23, will claim she was acting in self defence when she thrust a knife into her estranged partner’s back in a bid to stop him from assaulting her father.
Bozinovski was granted strict conditional bail in Wollongong Local Court on Wednesday, after Magistrate Darryl Pearce accepted that the victim had been – up until the stabbing – the “real aggressor” in the incident.
Court documents said Bozinovski and the man were arguing on the phone around 4.30am when he allegedly threatened to run her father over while he was walking to work that morning.
Despite the apparent threat, Bozinovski’s father began walking to work shortly afterwards, declining a lift from his daughter and the victim’s sister, who was also at the house.
He later told police he was near Central Avenue when the victim pulled up beside him in a blue Hyundai, got out of the vehicle and began yelling threats at him.
Bozinovski also arrived at the scene in time to see her estranged partner punch her father in the mouth.
When the man approached her father again, Bozinovski lashed out with the knife. She later told police “it was self defence, I was protecting my dad”.
Bozinovski was charged with wounding with intent.
Magistrate Pearce acknowledged the matter was serious but said bail conditions including daily reporting to police and a $20,000 surety could mitigate the risk of Bozinovski not turning up to court.
The case returns to court on December 7.
