Bruce McClintock SC was grilling Mark Tedeschi QC, the prosecutor who put Gordon Wood behind bars, about his closing address to the jury who convicted him of murder.

In 2008 Mr Tedeschi told the jury that two witnesses who said they saw a green two-door Bentley driving near the Gap on the afternoon before the death of Caroline Byrne might have actually seen a four-door model.

Mr Wood often drove a unique four-door Bentley belonging to his boss, the late flamboyant stockbroker Rene Rivkin. Ms Byrne, a 24-year-old model, was his girlfriend.

???Mr McClintock put to Mr Tedeschi that he was trying to place Mr Wood at the Gap, a notorious suicide spot at Watson's Bay in Sydney's eastern suburbs, in the hours before Ms Byrne's death, despite there being no evidence to support such a contention.

Mr Tedeschi, who has been the state's most senior Crown prosecutor for two decades, said he was "perfectly entitled" to suggest to the jury the witnesses may have actually seen a four-door Bentley, rather than a two-door.

"I think I presented that evidence very fairly to the jury. I then made a submission that [the witnesses] Melbourne and Martin may have been mistaken. I invited them [the jury] to consider it with rest of the evidence."

Mr McClintock said the two-door and four-door versions of the Bentley were "completely different cars" - one being like a sports car and one being more like a stretch limousine.

"I believe I was perfectly entitled to make that submission. It's perfectly appropriate to suggest a witnesses' observations may be in error and to suggest what the observation may have been," Mr Tedeschi said.

"It was a little drop of illegitimate poison you were putting in the jury's mind", Mr McClintock said.

"I disagree," Mr Tedeschi replied.

"I want to suggest it was really quite dishonest," Mr McClintock said.

"I disagree", Mr Tedeschi replied.

The prosecutor went on to say the Bentley "wasn't the strongest evidence" but "a little bit of extra evidence which might assist the jury as to whether Mr Wood had been present at the gap at that time".

Mr Wood was found guilty of Ms Byrne's murder. He spent three years in jail before he was sensationally acquitted by the Court of Criminal Appeal in 2012.

In acquitting Mr Wood, Justice Peter McClellan??? found the Bentley seen at the Gap was most likely owned by millionaire advertising mogul John Singleton.

Justice McClellan said the prosecution "no doubt intended" to use the evidence about the sighting of the car to reinforce the relationship between Mr Wood and Mr Rivkin, given one of the suggested motives for murder was to protect the stockbrokers's reputation and Mr Wood's job.

Mr Wood, 54, is now suing the state of NSW for millions of dollars in damages, claiming malicious prosecution.

On Thursday, supporters of other people Mr Tedeschi has prosecuted were in the public gallery.

Kathy Lin, the wife of Robert Xie, who was earlier this year found guilty of killing five members of the Lin family, sat in for some of Mr McClintock's cross-examination of Mr Tedeschi.

Also present was Rachelle Louise, the former girlfriend of Simon Gittany, who was found guilty of throwing his fiance Lisa Harnum from the balcony of their 15-storey high city apartment.

Mr Wood's statement of claim before the NSW Supreme Court alleges the state, via Mr Tedeschi, "misconducted" itself in various ways, including offering his own opinion to the jury and changing his case during the trial.

"The defendant, through the Crown prosecutor, misconducted itself at trial, making inappropriate submissions to the jury in relation to the plaintiff's motives using speculative smear, speculative assumptions, and the exploitation of public rumour and the use of mere innuendo to compensate for inadequate evidence," the court document alleges.
