Police failed in their attempt to have Gerassimos Madonanankis, also known as Jack Madonanankis, remanded in custody during a recent court appearance, despite suggesting he would be a threat to public safety if released into the community.
The 41-year-old is accused of helping a co-accused attack two men inside the Mr Crown nightclub, leaving one of the victims requiring surgery on a shattered jaw.
Court documents reveal there had been a history of animosity between the parties. It is alleged a confrontation inside the venue on November 11 last year resulted in the men repeatedly punching the two victims in the head.
Both groups were eventually removed by security staff.
Court documents reveal while one of the victims had relatively minor injuries including bruises and scratches to the head, the second victim was admitted to hospital with two teeth out of place and a cut lower lip.
Further scans and x-rays revealed the victim required surgery to reconstruct his jaw and the removal of two wisdom teeth as a result of the attack.
The court heard he had suffered ongoing psychological and medical problems since the incident.
Meantime, police arrested Madonanankis on December 8 and charged him with affray and assault occasioning actual bodily harm.
He denied any involvement in the assault, claiming he wasn’t even at the hotel that night. Police granted him conditional bail at the time.
However, police claim Madonanankis breached that bail less than a month later when he allegedly assaulted a former friend at a popular south coast fishing spot on January 4.
Court documents say the two men were fishing separately inside the Beecroft Weapons Range at Jervis Bay when Madonanankis allegedly approached the victim and abused him over the contents of a Facebook post.
It is alleged Madonanankis then tackled the man to the ground, punched him in the face and grabbed him in a headlock before eventually letting him go.
The victim left the are and reported the incident to police.
Madonanankis was arrested last week and charged with assault occasioning actually bodily harm.
In court, Madonanankis’ lawyer said his client denied assaulting the victim and intended to fight the allegation.
Magistrate David O’Connor granted Madonanankis bail on the condition he not approach the victim.
Both cases return to court on February 13.
