Edwin Haitana, 22, will remain behind bars until at least February on assault and intimidation charges over allegations he threw a house brick at his sister and threatened to kill her in her sleep during a confrontation between the pair at a house in Albert Street last Friday afternoon.
The woman was later treated by paramedics for “severe swelling”, cuts and bruising to her left leg.
Haitana was arrested while reporting on bail at Lake Illawarra Police Station on Saturday evening and charged with assault and intimidation offences.
He applied for bail in court on Sunday but it was refused by Registrar Cally D’Arcy, who noted Haintana was already on strict Supreme Court bail over his alleged involvement in a violent group home invasion with four other men at Mangerton last October.
Haitana fronted court again on Monday, making a fresh bail application as his mother and friends watched on from the public gallery.
Defence lawyer Stewart Holt said Haitana had been assaulted while in prison on remand for the home invasion charge and feared returning to custody.
“He still carries some bruising from that assault,” Mr Holt said, adding his client would agree to abide by conditions that were akin to house arrest if released.
Police opposed Haitana’s application and provided photos to the court of the victim’s injuries, which they said was consistent with her version of events.
Haitana has previously admitted throwing the brick but denies it ever hit his sister. He claims she was the main aggressor and that she spat in his face, and scratched and punched him during the confrontation.
However, Magistrate Susan McGowan refused to release Haitana, finding he hadn’t shown cause why his ongoing detention wasn’t justified. She described the allegations against him as “alarming”. The case returns to court in February.
