In 2013 the state government put together a business case for the freight line as part of a process to gauge private sector interest in building it.
Four years later it was this business case that the federal government cited when rejecting the line for funding.
Wollongong MP Paul Scully had lodged a freedom of information request for the business case, and its release was refused by Transport for NSW.
The MP appealed the department’s decision to the NSW Information and Privacy Commissioner.
He said the release of the business case was “important for the ongoing debate and scrutiny of this project”.
The commissioner found that Transport for NSW’s decision was “not justified”.
“The review recommends the agency make a new decision,” the commissioner’s finding stated.
Mr Scully was pleased with the decision.
“Taxpayers have paid for this business case and they should be allowed to see it warts and all,” Mr Scully said.
