Jailed woman fails to sue government

A Warilla woman who stabbed her cooking teacher to death as a teenager has failed in her attempt to sue the State Government for jailing her.The NSW Supreme Court ruled that Debbie Marie Adams, 26, was largely responsible for stabbing Scott Bremner, 32, at the Yasmar juvenile detention centre in 1999 and dismissed her compensation claim.Adams claimed her history of violence - she was at Yasmar on remand for stabbing her mother earlier in 1999 - should have meant staff prevented her accessing a knife.By allowing her access to a knife in the cooking class, Adams claimed Yasmar had breached its duty of care and should pay damages for her decade-long loss of liberty that resulted from that alleged breach.Adams had suffered from a psychiatric illness.Justice Stephen Rothman's judgement said: "I accept the opinion of Dr Rosalie Wilcox that Ms Adams was not 'insane' but had a diminished capacity to control her actions."The judgement said she was prone to unprovoked bouts of violence and anger.Adams could have been predisposed to the disorder or it could have been caused by the sexual and physical abuse she suffered as a child."Ms Adams was the subject of significant sexual and other abuse from a very early age," the judgement said.When she was five, Adams was found to have chlamydia of the throat and was removed from her mother.However her mother continued to sexually assault the child on access visits when Adams was eight.On one such visit, Adams threatened her mother with a knife.She had behavioural problems throughout her teenage years and was expelled from Albion Park High School in 1997.In January 1999, at the age of 16, Adams stabbed her mother, was charged with attempted murder and sent to Yasmar detention centre in Sydney's inner-west.During a cooking class in July that year, Adams was given a toolbox for the class which contained a large cooking knife.During the recess break she threatened to stab the assistant principal and another teacher."The teacher's aide spoke to the two other staff in the (cooking) class about her fears about Ms Adams and the knife," the judgment said."She had concerns because the knives looked like killing knives and she was aware of the charge of attempted murder and some of the other violent outbursts attributed to Ms Adams."Neither of the other staff seemed particularly concerned."Later that day Adams walked up behind Mr Bremner and stabbed him in the back while the other girls screamed hysterically.Mr Bremner later died from the wound.Adams was eventually sentenced to three years' jail for stabbing her mother and 10 years for killing Mr Bremner.During the court proceeding in 2001, forensic psychiatrist Dr Wilcox said: "In my opinion she was in a dissociated state before she picked up the knife and while she was in this state she might have felt that she was stabbing her mother."At that time, Justice Sperling noted Adams was living in "inhumane" conditions.Adams' sentence is due to expire in January 2012.
