Warilla teen bailed on firearms, drug charges

A Warilla teenager who allegedly kept a shotgun under his bed has been bailed to face court next month on firearms and drugs charges.Officers from the Lake Illawarra Crime Investigation Unit searched the Barnes St home of Justin Gardener, 18, at 9.30am on Saturday. They allegedly located the single-barrel 12-gauge shotgun in pieces under his bed, together with shells and shotgun rounds. In a dressing table drawer police say they found 10 resealable plastic bags containing cannabis and 10 individually wrapped sticks of cannabis in foil. Also found was a set of scales and other drug paraphernalia.A coded safe located in the bedroom allegedly contained more cannabis and a wallet with three bundles of $50 notes in $2000 lots, totalling $6000.Gardener was taken to Port Kembla Police Station and charged with possessing an unauthorised firearm, buying ammunition for a firearm without a licence or permit, supplying a prohibited drug, possessing a prohibited drug, dealing with property suspected of being the proceeds of crime and not keeping a firearm safely.Police prosecutor Sergeant Ron Davis opposed bail on the grounds that Gardener was the subject of a controlled court order, that he had an extensive juvenile record and he might pose a danger to society."The amount of ammunition found in close proximity to the firearm and the reason for having it would be of concern to the court," Sgt Davis said.Legal Aid solicitor Nerissa Keay said Gardener had previously been the victim of a serious robbery with a Taser gun and the people responsible had been arrested and charged, their bail refused.Ms Keay said he kept the gun because he felt unsafe and wanted to protect himself and his mother.Court registrar Peter Ritchie said Gardener's criminal record "for one so young is not a good one to have"."The bail record covers everything, all your juvenile matters and now you've embarked on your first adult matters as well," Mr Ritchie said.He noted Gardener had no charges in his record regarding violence towards others, or for previous drugs and firearms offences.Mr Ritchie bailed Gardener on condition he be released into the custody of his father. The case was adjourned to November 10.
