Gordana and Roger Ocvirk fronted Wollongong Local Court yesterday to face allegations that they fraudulently omitted to account for $1,235,402.67 from their business Strata Decisions Wollongong.

Mr Ocvirk, who went missing for several days last year, is also accused of failing to account for nearly $200,000 received by his other business, Dougmal Harcourts Warilla.

Mr Ocvirk, a keen cyclist, disappeared in January last year, mystifying his family and friends.

Police found him sleeping in his car in Grafton nearly a week later.

The Ocvirks, both 39, have also been charged with failing to properly supervise operations at Strata Decisions.

All the incidents are alleged to have occurred between August 1, 2010 and January 31, 2012.

Both businesses operate under the company Bayelm Pty Ltd.

NSW Fair Trading started investigating the Warilla real estate agency when they discovered an alleged $1-million gap in its books.

Auditor Deloitte Touche Tohmatsu was appointed in January last year to manage Dougmal Harcourts Warilla after alleged discrepancies totalling $1,050,000.

Bayelm Pty Ltd co-director Tom Ivan Imre also appeared in court yesterday.

The 32-year-old is charged with failing to properly supervise the real estate agency's operations.

He has not been charged with any fraud offences.

The Barrack Heights man applied for a Supreme Court injunction against the Ocvirks last year, seeking to prevent the couple from dealing with the company's assets.

He had also sought damages and compensation from the pair.

It is understood the proceedings were dismissed in June.

The court was told yesterday Imre wanted his matter adjourned so he could mount a case for it to be dismissed.

He is set to reappear in court on February 21.
