Spinks was arrested on Thursday morning during a vehicle stop at Warrawong - nine months after Costello was gunned down in an early morning hit which police will allege was a “targeted attack”.
Dressed in a white t-shirt with his hair unkempt from spending a night in a holding cell, Spinks appeared briefly in Wollongong Local Court on Friday morning where he did not apply for bail and it was formally refused.
Defence lawyer Matt Ward told the court Spinks would likely make a bail application before his next court date on September 5.
Mr Ward said he required the police brief of evidence to be served first in order to prepare for the application given what appeared to be the “circumstantial nature” of the case against his client.
Spinks remained silent throughout the proceedings until the very end, uttering a simple “yeah” when asked if he’d understood what had happened.
