Tearful account of victim

Two vastly different images of manslaughter victim Scott Mahoney emerged in a packed Wollongong District Court yesterday.His younger sister Tamara Mahoney told of a kind man who was the rock of his family and rushed to his sister's side when she needed him.The man who killed the 33-year-old with a single blow to the head, Solkan Mohammed Donaczy, described an argumentative man who used racial slurs to spark a fight outside the Commercial Hotel, in Port Kembla.The court room was packed with Mr Mahoney's family and friends, and Donaczy's supporters for the first day of his sentencing submissions before Judge Paul Conlon.Ms Mahoney struggled to read her victim impact statement through tears, saying her life changed forever on March 17, 2007, when her kind and caring brother was killed."A piece of my heart has been ripped out," she said."He was the best. Always there for me when I needed him."It's been a long, hard, stressful process having to come here and look at the person responsible for my heartache."I will never understand how anyone could take my brother's life and I will never be able to accept his death." Later Donaczy, who pleaded guilty to manslaughter in July, said he and Mr Mahoney had both been at the hotel on the evening of March 16 and had "interacted".The 28-year-old said he had argued with one of Mr Mahoney's friends a few years earlier and Mr Mahoney was trying to revive the old feud that night."I said: 'Listen, it's got nothing to do with you. I'm not even worried about it, it's water under the bridge, I don't want to carry on with it'," Donaczy said."He was throwing racist remarks (at me)."Donaczy, of Port Kembla, said he tried to avoid confrontation with Mr Mahoney throughout the evening, but when they all left the Commercial Hotel about 3am, Mr Mahoney made more racist remarks.Donaczy admitted punching Mr Mahoney in the face, which caused him to fall to the ground, dead.However, the police facts tendered to Judge Conlon said Donaczy punched Mr Mahoney in the back of the head in an unprovoked attack.CCTV footage of the attack was shown to the court, but was blurred as moisture had got into the camera lens.In the film Mr Mahoney appeared to be alone, not with friends as Donaczy claimed.Donaczy said when he saw Mr Mahoney was not moving after he fell to the ground, he told bystanders to call an ambulance and turned Mr Mahoney on to his side."I was worried for him," Donaczy said.The security camera footage showed Mr Mahoney's attacker leaving the scene immediately after he fell.Donaczy said he was "pushed away" from Mr Mahoney.Mr Mahoney's death had left him traumatised, he said.The case was adjourned to December 17.
