The CFMMEU's Victorian secretary has gone to the state's Supreme Court in a bid to prevent a motion to remove him as a delegate over claims he is not living up to the party's values.

In court documents, Mr Setka pleads for a motion by Labor leader Anthony Albanese to be stopped because expelling him from the party would prevent him being an effective advocate for the union and its members.

The party was due to meet on Friday to consider a motion but Mr Setka has already been granted an extension until July 15 to prepare his case to remain.

Mr Setka was last week convicted for harassing his wife and has faced accusations of making inappropriate comments about anti-violence campaigner Rosie Batty, which he denies.

He argues the party's national executive does not have the power to expel him in the way they seek to.

He has filed proceedings against the party's national secretary Noah Carroll, Mr Albanese and voting members of the national executive.

In a supporting letter, Mr Setka says he considers the union movement to be part of his identify.

Expelling him from the party would leave him unable to advocate effectively on behalf of the union and could affect his position as state secretary.

"Losing the position of secretary would have a devastating impact on me as I have dedicated my life to the union movement," he says.

Being expelled for the reasons alleged by Mr Albanese would also affect his reputation.

"As I understand it, he is alleging that the way I conduct myself is so reprehensible that it is necessary for the national executive to take the extraordinary step of expelling me," Mr Setka writes.

"I strongly disagree with his allegations."

Mr Albanese told reporters in Canberra he would be pressing on with the expulsion.

"He won't be advocating as a member of the Labor Party after July 15th," Mr Albanese said.
