Judge Andrew Haesler received a note about 11.30am that read, "despite careful consideration of all available evidence we have been given, we are unable to reach a unanimous verdict."

He has asked all 12 jurors to return to deliberations, to calmly discuss the evidence and the points of difference that has resulted in them being unable to reach a unanimous decision.

"I urge you to go back to the elements and evidence, to the points that divide you as jury and give renewed but calm, logical and rational consideration to the evidence, points of law and things that divide you," Judge Haesler said.

"It is your duty to listen carefully and objectively, calmly and without emotion, to the views of your fellow jurors."

Judge Haesler said it was common for juries to return and say they could not reach a unanimous decision however, with further deliberations they often reached a verdict.

He said the jury would only be discharged if there was no likelihood of reaching a decision after further deliberation.

Judge Haesler indicated he would take instructions from the Crown and defence teams if after a certain period of time the jury still could not reach a unanimous decision.

The Crown alleged the NRL St George Illawarra Dragons forward, 29, and his friend, Callan Sinclair, 23, had aggravated sexual intercourse without consent in company with a then 19-year-old woman at a North Wollongong townhouse on December 9, 2018 following a night out at Mr Crown.

The men have pleaded not guilty to five counts of aggravated sexual intercourse without consent in company and claim the threesome was consensual.

The jury consisting of five women and seven men first retired to consider the evidence and their decision at about 10.30am last Thursday.

When they could not come to an agreement by Thursday afternoon they were dismissed until Monday 9.30am, when deliberations resumed at Wollongong courthouse.
