David Speechley Aiono, 38, appeared in Wollongong Local Court yesterday where he pleaded guilty to a charge of dishonestly obtaining financial advantage by deception.

The court heard the brothers grew up together in the Shellharbour area and lived together in 2013.

In agreed facts tendered to court, police started investigating suspicious activity in the 40-year-old brother's accounts when his finance was declined due to an outstanding debt when he applied for a loan to pay a veterinary bill in June 2017.

The brother conducted a credit check revealing his debt amounted to $22,000 from a personal loan with Commonwealth Bank.

He did not apply for the loan and suspected his brother had used his driver's licence in 2013 to secure the money.

The police investigation revealed a transfer of $14,000 was made into Aiono's NAB account on February 15, 2014, the day after the loan was approved.

Bank records also showed $10,000 was immediately withdrawn from the brother's account at the Wollongong branch of Commonwealth Bank.

On the same day, transaction records showed the brother withdrew $50 cash from a Commonwealth Bank ATM in Queensland.

Further investigation into the brother's driver's licence issued in 2013 revealed the photo on it depicted Aiono's face.

Aiono admitted to using his brother's drivers licence to fraudulently apply for and obtain the $22,000 personal loan from the Commonwealth Bank in the name of his brother before he transferred the money to himself.

In court, charges of dealing and possessing identity information to commit an indictable offence; and publishing false misleading material to obtain advantage were withdrawn.

Aiono will return to court on January 24 next year to be sentenced.
