The 37-year-old was served a court attendance notice on Friday morning for the offence of negligent navigation causing death.
He was the owner of the boat that capsized off Waniora Point on the morning of Sunday, October 31 last year.
After the boat overturned, surfers and life savers pulled seven men from the water and took them ashore to Bulli Beach.

One man, aged 37, died at the scene.
Two men, aged 39 and 42, were airlifted to St George and Liverpool hospitals in critical conditions while the fourth man, a 32-year-old, was taken to Wollongong Hospital.
They have since recovered.
The man now charged was treated for minor injuries and underwent mandatory testing, which returned a negative result.
Two other men, aged 38 and 33, were also treated for minor injuries.
