Former Wollongong City Council town planner Beth Morgan has escaped charges relating to Wollongong’s Independent Commission Against Corruption scandal after a two-year Department of Public Prosecutions inquiry found insufficient evidence.Three years on from the council corruption inquiry, the DPP has been unable to prosecute Ms Morgan for a string of offences.Identified by the state corruption watchdog, these related to gifts she received from a property developer, Frank Vellar.Ms Morgan was at the centre of the corruption inquiry into the council, which was told she slept with developers while processing their building applications. It was recommended by ICAC that she face 27 criminal charges.The investigation heard details of salacious sexual liaisons between Ms Morgan and Vellar, and with developer Glen Tabak, which led to favourable treatment of their substantial applications.The DPP has advised ICAC that there is not enough evidence to prosecute Ms Morgan for her dealings with either of the men, nor for her dealings with Ray Younan and Gerald Carroll, two convicted conmen embroiled in the scandal.The DPP also advised there was a lack of evidence for prosecuting Ms Morgan for her assessment of the Victoria Square or 14 Harbour St development applications.Ms Morgan was a key figure to be dealt with by the DPP over the council scandal, in an investigation where only those found to have lied to the corruption watchdog have been prosecuted.At the time of the hearing, Commissioner Jerrold Cripps had described the corruption within five levels of the council as being ‘‘unprecedented’’.He found 10 individuals had engaged in corrupt conduct, including Ms Morgan, Mr Tabak and Vellar. The council’s then-general manager Rod Oxley was found to have created a climate ‘‘liable to allow, encourage or cause’’ corrupt conduct.The news comes weeks before the Wollongong council elections.
