Duped car seller cops insurance blow

A Wollongong car seller duped by a cunning conman has been dealt another blow, this time by his insurance company.

In July, 23-year-old Jackson Emmett was the victim of an elaborate scam to steal the 1999 Subaru Impreza WRX he was selling.

Posing as a potential buyer, a well-dressed man took Mr Emmett's car for a mechanical inspection, leaving a licence, car and car keys as surety, but never returned.

It turned out the car was stolen.

While distressed about the swindle, Mr Emmett was thankful he had insurance, but this week was shocked to discover his claim to Just Car Insurance had been rejected.

"They basically said the car isn't covered if it's up for sale and that I had contributed to it being stolen because I didn't go in the car with him," he said.

"He spoke well, he was well dressed, if he was a low-life you can generally tell but he just seemed like a normal, decent guy.

"But now if I had gone with him who knows what would have happened."

Now borrowing a 15-year-old Mitsubishi Lancer, Mr Emmett said he had been anticipating an insurance payout and was experiencing financial difficulty.

He spoke out as a warning to others.

"When I opened the letter I was devastated," he said.

"I've been sitting here waiting to pay this loan and clear the debt so I can start saving for my wedding.

"I'm still paying the car off too, I still owe about $10,000. It was insured for $15,000 and the excess on that was $2500 so I would have gotten $12,500."

Just Car Insurance is underwritten by AAMI and specialises in insurance for young drivers, modified cars, high performance cars and imported cars.

In a two-page letter from the company addressed to Mr Emmett and dated September 2, claims manager Stephen Moloney outlined the reasons for the claim's rejection.

"... you are not covered for the theft of your vehicle if your vehicle was advertised for sale and was being driven by someone without you or a nominated driver on your policy being present," he wrote.

"It is clear that your failure to ensure your presence inside your vehicle whilst being test driven by the potential buyer, the purpose of which is to protect the vehicle against theft, has contributed to the loss."

Just Cars Insurance did not return calls from the Illawarra Mercury yesterday.

I think it's absoultely disgusting! How can they deny him of his insurance money? He took every precaution to make sure the guy was legit and they still won't pay!

What would of happened if he had gone with the guy? His life may of been put in danger.

This is another case of an insurance company posing as helping young drivers to gain insurance but ripping them off in the process.

Well - What a disapointment.

I think that Mr Emmett should take his business elsewhere and I would never give them mine !!!!!

What other precaution could he have taken to prevent this happening????

Seems a bit cruel to do this to a decent kid. I suppose it depends if this was made clear on his policy.

If not he should appeal, and find out what other companies' rulings are. It is a warning to all to make sure they are covered in all aspects.

What a disgrace.

He took all precautions, lic, phone, car and keys how is he supposes to know it's all stolen?

Shame on you Just Cars. Who knows maybe if he went in the car the guy might have stabbed him instead.

Most insurance companies have this clause so I suggest you all read your policies and find out, before crying wolf!

That sucks. Poor guy, I feel sorry for him. But in all honesty, how many of you would let a complete stranger take a car of this value for an 'inspection'. Best case scenario, he would belt the living daylights out of the car and bring it back with more problems than before. I for one would never, regardless of what he offers to with me as security. He should have offered to meet him at the mechanic, and gone with a couple mates himself.

Come on! This guy freely handed over the keys to his car, how can the insurance company be expected to pay out on that? Would you trust a complete stranger with $15 grand cash. That is basically what he did and now he wants us to pay him for it through our insurance premiums? I say it is his fault and the insurance company is right. We all make mistakes and have to pay for them. That is what this guy needs to accept!

It's a WRX, why would he be so stupid to just give the keys to a complete stranger. The Just Car PDS states clearly that he is not covered if he did this, yet he still did. Sucks to be you but just goes to show that people should read their policy wordings. What is the famous saying? "A Fool and his money are soon parted".
