Alan O’Toole, 69, appeared in Wollongong Local Court this morning to answer a charge of common assault.
He admitted to kicking a bent over Cr Petty in the buttocks on the morning of October 27 following an argument over land rezoning between the pair at the Helensburgh Fair.
The court heard O’Toole was "deeply ashamed" of his actions.
His solicitor, Ted Bramble, tendered copies of his service record with Qantas, saying O’Toole was a man who, at 69, had never been before a court for ill-behaviour.
Magistrate Holdsworth agreed, saying O’Toole appeared to be a man of "exemplary character".
She dismissed the matter without any conviction being recorded.
