The NSW Bar Association had ruled that it could not be satisfied that Scott John Roulstone was a fit and proper person to hold a practising certificate.

On Friday the NSW Supreme Court overturned the decision and granted Mr Roulstone an interim practising certificate.

The ruling follows a similar victory by Mr Roulstone against the Council of the Law Society, whose decision to refuse him permission to practise as a solicitor was overturned in June last year.

In refusing to issue a practising certificate, the Bar Association said allegations of contempt of court against Mr Roulstone are pending and it was concerned with protecting the public from him.

Mr Roulstone was involved in the long-running Keddies' overcharging scandal in which the firm gouged many of its disabled and injured clients.

Mr Roulstone and fellow partners Russell Keddie and Tony Barakat declared themselves bankrupt in August 2012 after being forced to repay millions of dollars.

On top of concerns about his conduct in declaring bankruptcy, Mr Roulstone is alleged to have attempted to interfere with former Keddies clients who were suing the partnership to recoup what they were owed.

On Friday Justice David Davies ruled Mr Roulstone could work as a barrister until the end of June unless the contempt of court case proceeded and found against him.

"I do not consider that the matter of the protection of the public is significant in this case to result in a refusal of an order," he said.

Bar Association president Jane Needham, SC, said the association would comply with the court's order and issue Mr Roulstone an interim certificate.

"The first priority of the Bar Council in the exercise of its regulatory functions is and always has been the protection of the public," she said.

Justice Davies said the Bar Association's concern about Mr Roulstone's bankruptcy had been negated by the June 2014 decision of Justice Robert Beech-Jones to allow him and Mr Barakat to again work as solicitors.

In that case, the court heard Mr Barakat and Mr Roulstone filed debtors' petitions after concluding they would be unable to meet all their claims as well as the capital-gains tax arising from the sale of the Keddies personal injury firm to Slater and Gordon.

In doing so, each transferred assets and funds to close associates and stopped paying their former clients' claims.

Mr Barakat gave three luxury cars to his family in 2012 and his share of the $2.2 million from the sale of his five-bedroom Roseville home on Sydney's north shore went straight to paying off his wife's habourside Quay Grand penthouse valued at $4.8 million.

In finding they were unfit to practise, the council said those transactions were done deliberately to benefit themselves.

But Justice Robert Beech-Jones said Mr Barakat and Mr Roulstone "did not act dishonestly". Each sought advice from an experienced insolvency practitioner, who advised them to set aside funds for the purpose of negotiating with their creditors to avoid bankruptcy, he said. Each of the transactions were disclosed to their trustee in bankruptcy.

Justice Beech-Jones found "while Mr Barakat and Mr Roulstone furthered their own interests, they also had regard to and considered the interests of their creditors".

During disciplinary proceedings in 2012, Mr Keddie took responsibility for the overcharging and has not sought to renew his practising certificate.
