“Ms Hay had received advice via her lawyer that she is not a suspect in relation to Australian Federal Police inquiries undertaken at her electorate office in July 2015,” a statement from the MP’s office, issued a short time ago, says.
“As such Ms Hay will resume her position effective today.”
Two Australian Federal Police officers raided Ms Hay's Crown Street office on July 1.
Police were acting on a December 8 referral from the Australian Electoral Commission, lodged two days after Ms Hay was re-endorsed in a controversial Wollongong Labor preselection ballot.
The preselection was plagued by allegations of branch stacking, doctored minutes and dodgy attendance books.
Ms Hay stood aside as Opposition Whip pending the outcome of the investigation.
The Mercury understands the investigation involved a staff member.
Ms Hay did not comment on the matter while police remained involved. She did not return calls late Tuesday.
The Mercury has sought comment from the AFP.
