The owners of a popular Cliff Rd cafe have declared this weekend's trade will be its last, due to a long-running dispute with the body corporate in the building where it operates.Verdi's House of Fine Food and Coffee, operated by Wollongong couple Alex and Julieanne Verdi, has been subject to a legal battle with residents from The Strand apartments. The matter was due in the Land and Environment Court on October 31, to resolve noise, ventilation and waste storage issues.Verdi's and the neighbouring Aqua cafe occupy the ground floor of The Strand development, and have traded without council approval since 2004.According to Wollongong City Council, the body corporate has the final say on whether the application can proceed through to council assessment.Last November, The Strand's owners approved a development application for the day-to-day running of Aqua cafe.A spokesman for The Strand's strata management, Don Driscoll, said Aqua addressed a number of concerns in its successful application - which had not been adhered to by Verdi's, whose development application had been refused because "they persist on putting documentation in front of the owners ... that is flawed and has omissions".He said Aqua's owners had agreed to install exhaust ducting to remove oils and odours, alter their closing time from 10.30pm to 9.30pm, serve only coffee after 8.30pm and reduce seating by a third.Mr Verdi said he had submitted five separate development applications to Wollongong council, all without success."We are subject to the body corporate's decision ... which is why we've made a commercial decision to close the business," he said."We would like to thank our staff past and present [presently five employees], and all our loyal customers."Of the five Verdi's applications - the most recent in February - two did not strive for consent from the body corporate, according to Wollongong council."Council refused the application because the owner did not have the consent of the strata owners," a spokesman said. "Each application has been rejected owing to lack of information on the application and issues regarding noise, ventilation, and waste storage."Verdi's will be open for the last time tomorrow.
