The incident was reported on May 6 by the miner on May 6, which advised that the likely source of the turbid discharge was a stormwater pipe which had been "damaged by repair works".
The EPA undertook sampling at the creek on the following two days and confirmed elevated levels of turbidity, concluding it reasonably suspected a pollution event was taking place.
The clean-up orders consisted of ordering Wollongong Coal to provide a plan with details of repairs planned, investigations as to the cause, and details of how to reduce turbidity.
Wollongong Coal has been hit with financial penalties over the creek before - over failure to complete creek realignment works, and over previous discharge into the same creek.
