The former Maguire and McInerney employee and veteran of the legal industry stands accused of carrying out a $2.3 million fraud scam over a six year period that allegedly saw him embezzle $730,000 from the estates of dead clients.
The remaining funds in the alleged scam - some $1.5 million - are made up of fraudulent financial transactions Duncan allegedly made to cover his tracks.
Duncan made a brief appearance in Wollongong Local Court on Wednesday represented by prominent Sydney solicitor Sam Macedone.
Mr Macedone confirmed outside court that he expected his client would enter a plea of guilty to two charges of dishonestly obtaining a financial advantage by deception when the matter returned to court in June.
Duncan refused to comment when when asked if the court proceedings were taking a toll on him and whether he wanted to apologise to the alleged victims, which include overseas beneficiaries of at least two estates where Duncan had been appointed as the sole executor.
The Mercury understands police allege Duncan used sophisticated tactics in an attempt to cover his alleged offending, including creating false documents to make the money he allegedly siphoned out of the estates look like legitimate expense payments and beneficiary transfers.
Maguire and McInerney confirmed they discovered the anomalies in August 2017 and immediately brought in a team of forensic accountants, who confirmed the extent of the alleged theft in November.
Duncan was fired immediately while the firm notified affected parties and took out a loan to repay them in full.
