Twenty-year-old Kyle Proctor was in Wollongong Bail Court over the alleged assault of a security guard at the Grand Hotel, which police claimed was caught on CCTV.
Proctor had been charged with assault and resisting police.
According to the police facts tendered to court, Proctor “was well-affected by alcohol” when he tried to gain entry to the Grand Hotel at 1.45am on Sunday.
The two security guards at the door refused to allow him in because he was drunk.
Proctor then allegedly argued with one of the guards, which was witnessed by police officers at the hotel dealing with a separate incident.
Police allege he then became aggressive and, despite the efforts of the second guard to move Procter away, the accused then punched the first guard in the mouth.
He then ran away down Burelli Street, with police and one of the security guards giving chase.
Police caught him and then they allege he struggled with them during the arrest.
In court, police prosecutor Sgt Pavlin opposed bail, saying Proctor was already on two sets of bails at the time of the alleged offence.
“All of the matters that are before the court relate to alcohol consumption,” she said.
Sgt Pavlin added that Sunday’s alleged offence was also “alcohol-fuelled”.
Legal Aid solicitor Claire Carpenter agreed it was clear “there’s an unresolved issue with alcohol”.
She said if granted bail Proctor would agree not to consume alcohol or enter any licenced premises.
She said he needed to be on bail to continue his six-day-a-week civil construction job and also to trial with Fernhill soccer club, where he was under contract.
The registrar felt community safety and the possibility of Proctor not returning to court were enough to refuse bail.
“It’s a strong prosecution case and there is a likelihood of a custodial sentence,” the registrar said.
Proctor will appear before Wollongong Local Court on November 12.
